Abhishek Giri’s habeas corpus petition dismissed

BIRATNAGAR: The High Court Biratnagar has dismissed a writ of habeas corpus filed by Abhishek Giri, who was arrested on charges of extorting the ration allowance and labor wages of inmates at the Morang Jail.

A joint bench of High Court Judges Ganesh Thakur and Narayan Prasad Regmi delivered the verdict dismissing the writ on Wednesday, following a hearing on the petition filed by Giri naming the District Police Office and District Court Morang as defendants.

Although the writ was dismissed, the court issued a directive order setting a specific deadline for the police to complete the investigation.

According to Santosh Pokharel, the Information Officer at the High Court Biratnagar, the court has ordered that the investigation be concluded and the charge sheet be registered within five days, effective from Thursday.

“The court has directed that the investigation into the criminal profit (extortion) case be completed and the report submitted within five days,” Pokharel said. “If the investigation cannot be completed within that period, it has been ordered to release him from custody and proceed with the investigation while keeping him outside.”

Previously, the Morang Police had been investigating Giri in the criminal profit case by extending his remand.

The latest five-day remand extension granted by the District Court is set to expire on Thursday.

With the court’s new order, legal pressure has been created for the police to wrap up the entire investigation process within the next five days.
