Attorney office decides not to prosecute Durga Prasai’s bodyguard and nine others amid insufficient evidence

KATHMANDU: The District Government Attorney’s Office, Kathmandu, has decided not to pursue charges against Deepak Khadka, the bodyguard of Durga Prasai, and nine others, citing a lack of evidence.

Those spared prosecution include Gopikrishna Khadka, Santosh Chaudhary, Ram Kumar Dhimal, Ani Kunwar (alias Anita Kunwar), Shishir GC, Khem Raj Sedhain, Manoj Thapa, and Anil Basnet.

The office explained its decision, stating, Since the objective evidence of involvement in the present crime has not been seen from the investigation so far, it will be done according to the law when additional evidence is obtained against them. Thus, it has been decided today not to prosecute them for the time being.

Deepak Khadka and Durga Prasai were arrested in Assam, India and subsequently brought back to Nepal. Ani Kunwar also came under scrutiny following a viral video of her leaving a burnt house during the March 28 incident. Despite suspicions of her involvement, authorities stated her presence at the scene was related to journalistic activities rather than criminal intent.

The The District Government Attorney’s Office has already released the nine individuals and will forward the decision to the High Government Prosecutor’s Office in Patan for further review. Ultimately, the Attorney General’s Office will make the final determination on the matter.

Meanwhile, the government prosecutor has decided to move forward with charges against 61 individuals, out of the 108 recommended by police. Cases against four minors are set to be filed in the Juvenile Court.
