Nepal Bar Association expresses concern over recall of ambassadors

KATHMANDU: The Nepal Bar Association (NBA) has expressed serious concern over the government’s decision to recall ambassadors while a related case is still pending before the Supreme Court.

In a press statement issued on Wednesday, NBA General Secretary Kedar Prasad Koirala highlighted that the Supreme Court is currently considering the matter and has issued an interim order.

“In this context, the government’s decision to recall the ambassadors and assign them to work at the Ministry of Foreign Affairs raises serious concern,” the statement said.

The NBA stressed that any act that undermines or bypasses a court decision indirectly promotes arbitrariness. “We earnestly appeal to all concerned to fully comply with the court’s order or judgment and refrain from any actions that could shake public confidence in the judiciary,” the statement added.

While the Bar acknowledged that healthy academic or legal debate regarding a court decision is acceptable, it emphasized that compliance with the court’s orders—direct or indirect—is a legal duty.

The statement further noted, “Under constitutional provisions, the principles of constitutionalism, independent judiciary, and Article 128(4) of the Constitution, any action that produces results contrary to a court order, directly or indirectly, not only disrespects the court but also weakens the rule of law.”
