SC orders status quo on government’s decision to abolish Land Commission

KATHMANDU: The Supreme Court has ordered the government to maintain the current status quo regarding its decision to dissolve the Land Problem Resolution Commission and its district committees.

A single bench of Justice Megharaj Pokharel issued a short-term interim order on Wednesday, instructing the government not to implement the decision to scrap the commission.

The court has also directed the Office of the Prime Minister and Council of Ministers, as well as the Ministry of Land Management, Cooperatives and Poverty Alleviation, to submit a written response within 15 days.

“The court finds it necessary to discuss whether an interim order should be issued, taking into consideration the seriousness of the issues raised in the petition, the principles of due legal process and natural justice, the fundamental right to housing of beneficiaries under the abolished formation order, and the relevant provisions of the Land Act,” the order stated.
