Supreme Court refuses interim order in Hitendra Shakya case

KATHMANDU: The Supreme Court has refused to issue an interim order on the writ petition filed by Hitendra Dev Shakya, challenging the government’s decision to remove him from the position of Executive Director of the Nepal Electricity Authority (NEA).

A joint bench of Justices Abdul Aziz Musalman and Nripadhwaj Niraula made the decision on Friday, rejecting Shakya’s request for an interim order.

The order stated: “Since the subject matter, facts, and legal questions presented in this and similar writ petitions are identical, and as the constitutional and legal issues raised by the petitioner can be addressed and interpreted during the final hearing, it is deemed appropriate and necessary to decide all related cases together. Therefore, an interim order at this stage is not necessary.”

The Court has scheduled the next hearing for November 24.

Earlier, on November 3, Justice Niraula’s bench had issued a show cause order asking the government to submit a written response within seven days, and had summoned both parties for a hearing today.

Former Executive Director Shakya had filed the writ petition on Monday, claiming that the government had unlawfully transferred him from his post and seeking reinstatement.

Shakya was originally appointed as the Executive Director of NEA for a four-year term by the previous government, but the current administration decided to transfer him before the completion of his tenure.
