KATHMANDU: The Supreme Court (SC) has issued an order to summon the original file of the decision made by the Election Commission regarding the detention of medical entrepreneur Durga Prasai.
A joint bench of Justices Nahakul Subedi and Meghraj Pokharel on Monday ordered that the original file, including the decision stating that the Election Commission had sent a letter on 16 February 2026, based on which Prasai was arrested, be presented before the court.
The court has scheduled the hearing for February 24 (Tuesday).
In Monday’s order, the court stated: “The original file, including the decision by the Election Commission to write to concerned authorities for investigation and action against Prasai, shall be summoned through the Office of the Attorney General.”
Following the Election Commission’s directive on February 16 to investigate and arrest Prasai, the police arrested him and, after obtaining permission from the District Administration Office, kept him in custody.
Prasai had filed a habeas corpus petition at the Supreme Court, claiming that he was arrested and detained without valid grounds.
