KATHMANDU: The Supreme Court has refused to register a writ petition filed against the Constitutional Council’s recommendation of Supreme Court Justice Dr. Manoj Kumar Sharma for appointment as Chief Justice.
The petition argued that the recommendation made by the Constitutional Council was unconstitutional, claiming it was based on provisions introduced through an ordinance.
Senior advocate Dinesh Tripathi had filed the writ in the Supreme Court on Friday.
The petition claimed that bypassing the seniority order for the Chief Justice appointment could destabilize the judiciary and seriously undermine its independence.
Similarly, separate writ petitions were also filed by advocates Gita Thapa and Premraj Silwal. According to the Supreme Court, all three petitions were rejected for registration
The petitions had sought an interim order to halt Sharma’s recommendation, arguing that the judiciary was being pushed under the influence of the executive branch.
