Google has asked the Court of Justice of the European Union to dismiss an appeal by the European Commission seeking to reinstate a EUR 1.49 billion (USD 1.7 billion) antitrust fine that was overturned by a lower court in 2024. The penalty, originally imposed in 2019, accused Google of using restrictive clauses in its AdSense advertising contracts between 2006 and 2016 to limit competition in online search advertising. Google argued the Commission’s appeal lacks legal merit and said rivals had opportunities to compete. The Commission maintains the lower court applied an incorrect legal standard. A legal adviser is expected to issue a non-binding opinion in November, with a final ruling to follow.
